An occupational license is a restricted driver’s license that allows you to drive even if your driver’s license has been suspended or revoked. Typically, the occupational license only allows you to drive for certain periods during the day and only for work, school, or previously agreed upon personal duties. Sometimes, even though your suspension might be ended by payment of outstanding tickets and removal of traffic warrants, an occupational license will allow you to work and earn money in the interim to give you the time and funds necessary to resolve the outstanding issues. If you are suspended due to a medical disability, you may not obtain a regular license or an occupational license unless and until medically cleared by the DPS. Also, an occupational driver’s license will not permit driving vehicles that require a commercial driver’s license. In some cases, an occupational driver’s license is the best and quickest solution. For example, an occupational license may be the only remedy because your suspension has a definite end date that can not be removed until it expires.
To obtain an occupational license a sworn petition must be filed in the correct court and a filing fee must be paid to the court clerk. We will need to know your occupation, the address of your work, whether you are in school or are required to attend court-ordered activities, your driving hours for each day of the week, and where you need to drive. This is usually described in the order as blocks of time, and can be limited to certain counties and even roadways. You can be given more flexible driving privileges however, this must be documented on a driving log, to be filled in at the beginning and end of each trip. Additionally, courts can order monthly supervision, attendance at alcoholics anonymous, counseling, and an ignition interlock if the suspension is related to an alcohol or drug offense.
