FAQ’s and Facts
Who suspended my license?

In Texas, license suspensions are either by the Texas Department of Public Safety or by a court. DPS suspensions are referred to as departmental suspensions.

Why was my license suspended?

Suspensions can occur for a number of reasons, such as:

  • Being convicted of certain traffic ticket violations.
  • Driving when license is expired.
  • Getting a new conviction during a suspension or invalid period.
  • Being uninsured and at fault in an accident.
  • Breath or blood test refusal.
  • Breath or blood test failure following an arrest for DWI.
  • Unresolved matters from another state.
  • This list is not exhaustive and there are
many more reasons license issues can occur.
What happens if I drive without a license?
  • If you are stopped while your driver license is suspended, you risk an arrest or ticket for driving while license invalid or suspended.
  • This can result in an additional driver license suspension and fines with each conviction for driving while license suspended.

What To Consider If Your License Has Been Suspended

Driving while license suspended or invalid is a serious traffic offense and in certain cases can be a county court case involving not just a fine but jail time. You could be ticketed or arrested and a conviction for driving while license suspended or invalid could mean additional fines and suspensions. If you receive a Notice of Suspension from the DPS, call us immediately because deadlines to request a hearing are short

What It Means If Your License Has Been Revoked

While Texas law limits most suspensions to no more than one year (with some exceptions), a revoked license means the indefinite removal of driving privileges according to Texas Transportation Code 521.312.

Are You Eligible For Reinstatement

Eligibility requirements vary across cases and courts may order additional stipulations for drivers to maintain their restricted privileges. For example, someone convicted of a DWI may be required to install an ignition interlock that prevents the driver from operating a vehicle if alcohol is detected in their system.

Monthly supervision or regular check-ins may also be included.
Common issues that may prevent a driver from being eligible for reinstatement include any driver who is behind on their child support payments, someone deemed medically unfit to drive, or any driver seeking restricted privileges for a commercial vehicle.
